POLICIES AND TERMS

INTRODUCTION

  • Openstay, LLC (“we,” “us,” or “Company”) manages Hotel McCoy branded hotels. We are dedicated to providing an exceptional experience for our guests while ensuring their safety and privacy.
  • This document outlines the policies and terms established to support these commitments and enhance your stay at our properties.

RESERVATION POLICY

We believe the children are our future, but you must be 21 years old and present to book a room. Is it really you? A valid photo ID matching the name on the reservation is required upon check-in.

  • All requests to reserve a room must include the first and last names of all adults occupying the room and a valid credit card for guarantee of arrival.
  • All rooms are subject to applicable state and local taxes.
  • McCoy Tucson rooms are subject to a 12.05% tax (6% to City of Tucson, 6.05% to Pima County) AND a $4 per room, per night “bed tax” collected by the City of Tucson.
  • McCoy Pullman rooms are subject to a 9.9% tax (2% to City of Pullman, 7.9% for State Occupancy tax), per night “bed tax.”
  • McCoy College Station rooms are subject to a 15.75% tax (7% to City of College Station, 6% for State Occupancy tax, and a 2.75% local tax) per night “bed tax.”
  • Group trips are fun! When booking, keep maximum occupancy rules in mind - two people max for rooms with a single bed (Queen or King) and four people max for rooms with multiple beds. Got babies? We’ve got pack-and-play and cribs available upon request, subject to availability.

CHECK-IN POLICY

  • Reservations should be prepaid with Visa, MasterCard, Discover, or American Express. Upon check-in, any remaining amount due will be charged to your credit card, including the total amount of the room and tax as well as an additional $50.00 pre-authorization hold. 
  • The $50.00 authorization, less any room service or damage charges, will be returned to your card, dependent upon your bank’s policy, in 3-10 business days. 
  • A valid ID matching the name on the credit card must be presented upon check-in, or a previously approved credit card authorization must be on file.

CANCELLATION POLICY

Life happens. We get that. Reservations are fully refundable 48 hours prior to check-in. To cancel a reservation, please call us:

Cancellations received after 3:00 p.m. the day prior to check-in will not be refunded or credited and will be charged in full.

SMOKING POLICY

Breathe easy. We are a non-smoking property. 

  • This applies to both traditional smoking methods and all electronic delivery systems, including vapes, vaporizers, vape pens, hookah pens, electronic cigarettes (e-cigarettes or e-cigs), e-pipes, and any variations of the foregoing regardless of the product’s name.
  • Any smoking in the rooms or strong lingering smoking scents in rooms will result in a disappointed look and a $250 room cleaning fee.

PET POLICY

Are we pet friendly? You bet!

Dogs, quiet birds, and goldfish are welcome. Unfortunately, we are unable to host cats or venomous creatures. A maximum of two pets are allowed per room. No charge. Just make sure your furry friends do their business in the designated area and stay on a leash when outside the room. No rogue poopers and, sorry, no pets in the lobby or pool areas (that’s the health department’s call and we’ve gotta heed their rules). Pets cannot be left unattended in rooms at any time.

While there is absolutely no pet fee, a $50 pet deposit is required in the form of a credit card pre-authorization. Should your furry friend shed a significant amount or have a potty accident in the room, a cleaning fee will be charged to the credit card on file in the amount of $25-250. Should your pet cause property or item damage, an incidental fee will be charged at market value to your credit card on file.

Any funds remaining from the pre-authorized amount will be released after check-out and dependent upon your bank’s policy, will reflect on your account within 10 business days. Again, no cats or venomous creatures.

ROOM POLICY

  • We want you to have a great time when you are here. But if things get too wild, we go by the old-school rule of ‘you break it, you buy it,’ and property damages or missing items will be charged to your credit card at hotel market value. 
  • Pre-existing damages or room issues must be reported to the front desk immediately after registration to avoid responsibility and potential charges. 
  • We allow guests, with permission, to receive occasional packages and special deliveries at the property.
  • We are not responsible for the packages or their contents, or their storage. 
  • Sing your heart out and have a passionate conversation all day long, but from 11:00 p.m. to 7:00 a.m. we go into hush mode for what we like to call quiet time (or sleep time).

KITCHEN ROOM POLICY

Some of our properties have kitchen rooms (neat, huh?). 

  • Please practice safe cooking habits and do not leave burners unattended. 
  • Also, please do not cook with strong-smelling ingredients. Lingering smells that require room closure and deep cleaning will be charged a cleaning fee of up to $100.

PARKING POLICY

  • Vacations should be stress-free and for that reason, you get to park right in front of your room (or super close). 
  • By parking a vehicle on our property, you (and your guests) are doing so on your own accord. We do not take responsibility or accept liability for damage, accident, or loss to your vehicle or personal property. 
  • But guess what? We’ve got state-of-the-art surveillance cameras watching over the parking lot, so should anything seem amiss, let us know and we’ll check out the footage.
  • And if you plan on leaving your car in our parking lot for a while, not a problem, just let us know, as we reserve the right to tow vehicles.

MINIMUM AGE POLICY

All guests must be 21 years or older to confirm guest room accommodations. In addition, a valid photo ID must be presented at the time of check-in for age verification.

NON-DISPARAGEMENT POLICY

Guest agrees not to publish statement(s), whether online, through social media, or otherwise, which could be construed as defamation or disparagement. In the event such statement(s) are made, the publishing party agrees to take all steps necessary to promptly remove such statement(s) from circulation.

ALCOHOL POLICY

  • The good news? We have a bar! This means, by law, we can’t allow any alcohol to be brought onto the property. To uphold this law, we require all beverages on the property, including the pool (for locations that have a pool), to be purchased through the hotel, with the exception of transparent, see-through water bottles. 
  • The even better news? We offer more local beers and regional wines than any other bar in town. 
  • Guests must purchase beer and wine in the bar area – then, if you like, you can head back to your room (or the pool) to enjoy. Cheers! 

ROOM CLEANING POLICY

  • We are Beyond Clean – all guest rooms are cleaned above and beyond recommended standards (one of our founders is a self-proclaimed germaphobe). 
  • Once you check in, your room is yours. No need for a “Do Not Disturb” sign here. We will not enter your room unless you ask us to. 
  • What about room cleaning? Glad you asked! Room refreshes upon request. Should you stay with us for more than one night and want your room refreshed, please contact the front desk team by 10:00 pm the night before and include a one-hour window between 9:00 am and 2:00 pm the following day when you expect your room to be vacant. 
  • If you need fresh towels or linens during your stay, please contact the front desk

FIREARMS POLICY

Any guest or visitor who is in possession of a firearm on hotel premises is personally responsible for abiding by all applicable federal, state, and local laws with respect to firearms. Subject to the following restrictions, our guests who are lawfully permitted to possess a firearm may bring such firearm onto hotel premises, provided that the presence of the firearm on hotel premises: 

  • is for storage purposes only; 
  • the firearm is and remains at all times unloaded; 
  • the firearm is and remains secured in a locked, hard-sided firearm container, provided by the guest, while transported to or from the guest room and while stored therein; 
  • and the firearm remains securely safeguarded at all times in a locked guest room or locked personal vehicle, except when transporting the firearm to or from a guest room. 

Guests who fail to abide by this policy may be asked to leave the hotel premises, without a refund. The hotel premises are private property and our firearms policy applies to: 

(i) all firearms, regardless of whether the firearm is a handgun or a long-barreled gun; and 

(ii) all guests and visitors, even those possessing a valid license or permit to carry a firearm. 

The only exception to the restrictions described in this firearms policy statement is for law enforcement officers and designated Military Police officers who are on duty and required to carry firearms in the performance of their duties. 

GUEST SAFETY POLICY

As part of our commitment to guest safety, employees will not disclose the identity, room number, or presence of a guest to anyone other than appropriate law enforcement. This includes the taking of or delivery of messages or indirect forwarding of phone calls.

It is the responsibility of guests to communicate their presence and room number to any person they wish to receive calls or visits from. Safety cameras are used throughout the premises, and anyone on our property may be recorded. The hotel assumes no responsibility for any personal bodily injury incurred while using the gym/fitness center facilities, where available. If you use the gym/fitness center facilities, you do so at your own risk.

Privacy and Data Policy  

INTRODUCTION

  • We are committed to respecting the privacy rights of our customers, visitors and other users of our website (the “Site”). 
  • We created this Website Privacy Policy (this “Policy”) to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices and the protection of privacy. 
  • This Policy is only applicable to the Site, and not to any other websites that you may be able to access from the Site, each of which may have data collection and use practices and policies that differ materially from this Policy.

NOTICE CONCERNING CHILDREN

PLEASE NOTE: We are a general audience site, and do not direct any of our content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. If we learn or have reason to suspect that a Site user is under the age of 13, we will promptly delete any personal information in that user’s account.

WHAT BASIC INFORMATION DOES THE COMPANY COLLECT?

  • In operating the Site, Company may include registration, online surveys, and other online forms that ask users to provide information such as their names, e-mail addresses, mailing addresses, telephone numbers and credit card information. 
  • If you communicate with us by email, post messages via the Site, or otherwise complete online forms or surveys, any information provided in such communication may also be collected as personal information.

WHAT ADDITIONAL INFORMATION DOES COMPANY COLLECT?

  • AUTOMATIC COLLECTION. Our servers automatically recognize visitors’ domain names and IP addresses (the number assigned to computers on the Internet). No personal information about you is revealed in this process. The Site may also gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving the services we offer.
  • COOKIES. From time to time, we may use the standard “cookies” feature of major browser applications that allows us to store a small piece of data on your computer about your visit to our Web site. We do not set any personally identifiable information in cookies, nor do we employ any data-capture mechanisms on our website other than cookies. Cookies help us learn which areas of our site are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at our Web site may be diminished and some features may not work as they were intended.
  • You can opt-out to the creation of a user profile, Hotjar’s storing of data about your usage of our site and Hotjar’s use of tracking cookies on other websites by following this opt-out link.

WHAT DOES COMPANY DO WITH COLLECTED INFORMATION?

  • PERSONAL INFORMATION. We will not share your personal information with any third parties without your consent, except as necessary to provide you with the services offered by us or to comply with the law. We may share information such as contact data and financial data with our business partners who assist us by performing core services (such as hosting, billing, marketing, or data storage and security) related to our operation of the hotel or the Site. Those business partners have all agreed to uphold the same standards of security and confidentiality that we have promised to you in this Policy, and not to use your information for any other purpose. We may further use your personal information to verify your identity, or to fulfill or follow up with transactions initiated on the Site. We may also use your contact information to inform you of any changes to the Site, or to send you additional information about the Company.
  • ANONYMOUS INFORMATION. We use anonymous information to analyze our Site traffic, but we do not examine this information for individually identifying information. In addition, we may use anonymous IP addresses to help diagnose problems with our server, to administer our site, or to display the content according to your preferences. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.
  • USE OF COOKIES. We may use cookies to deliver content specific to your interests, to save your password so you don’t have to re-enter it each time you visit our site, or for other purposes. Promotions displayed on our site may contain cookies.
  • DISCLOSURE OF PERSONAL INFORMATION. We may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the edicts of the law or comply with legal process served on Company or its parent company, subsidiaries or affiliates, (2) protect and defend the rights or property of Company, other hotel guests, or the users of the Site, or (3) act under exigent circumstances to protect the safety of the public or users of the Site.
  • SALE OF INFORMATION. In order to accommodate changes in our business, we may sell portions of our Company or acquire other companies or assets. If Company or substantially all of its assets are acquired, customer information, including the information collected through this Web site, may be one of the assets transferred to the acquirer. We will not otherwise sell your personal information to any third party.
  • ACCESS TO INFORMATION. We do not currently maintain any procedures for you to review or request changes to the information that we collect about you, except that you may request that we remove all information about you from our database by contacting us per Section 7.1 below.

DO NOT TRACK DISCLOSURE

  • Most browsers offer “Do Not Track” (DNT) features that let you communicate to websites that you do not wish to be tracked around the web. The Internet industry is still working toward defining exactly what DNT means, what it means to comply with DNT and a common approach to responding to DNT requests. DNT was designed to limit tracking across different websites and online services, and not data collection from websites you visit directly. Therefore, our data collection and use is outside the scope of a DNT request and we do not currently recognize or respond to browser-initiated DNT signals.
  • Company does not track or collect personal information about your browsing activities across third-party websites or online services over time. Some third-party services that we may use, such as Google Analytics, may place their own cookies in your browser, however. You can decide if and how your computer will accept cookies by configuring your preferences option within your web browser. This Policy covers use of cookies by Company only and not the use of cookies by third parties.

SECURITY

The Site has security measures in place to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such occurrence, to you or to any third party, arising out of any such loss, misuse, or alteration. When you provide your credit card data, it is transferred over a Secured Sockets Layer (SSL) line, provided you are using an SSL-enabled browser. Please note, however, that no data security measures can provide guaranteed protection against hackers and identity thieves. Information collected on this website is processed and stored in the United States.

PUBLIC FORUMS

The Site may include interactive forums such as message boards and chat rooms. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

THIRD-PARTY WEBSITES

The Site may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.
